Nouvie Comforts‘ LIMITED WARRANTY

Nouvie Comforts, an Oregon sole proprietor company ("Nouvie Comforts"), warrants that the Nouvie™, the warm and comfy blanket with sleeves, ("Nouvie") will be free from defects in material and workmanship under normal use for 1 year from the date of purchase.

The obligation of Nouvie Comforts under this warranty is limited to the repair or replacement of the Nouvie™. This means that exclusive remedy for any defects in materials or workmanship shall be the obligation of Nouvie Comforts to repair or replace any Nouvie™ which shall be determined, to the satisfaction of Nouvie Comforts upon Nouvie Comforts’ examination, to have been thus defective.

For warranty service, the buyer must return the Nouvie™, at buyer's expense, to Nouvie Comforts together with written information describing the nature of the defect and the buyer's return address and telephone number. For mailing address please call 503-449-6755.

To the extent allowed by law, any implied warranty of merchantability or fitness for a particular purpose applicable to the Nouvie™ is limited to the 1 year duration of this written limited warranty.

This limited warranty gives you specific legal rights, and you may also have other rights which vary from state to state.

LIMITATIONS ON THE NOUVIE COMFORTS LIMITED WARRANTY

EXCEPT FOR THE LIMITED WARRANTY PROVIDED BY NOUVIE COMFORTS, THE NOUVIE™ IS BEING SOLD ON AN AS IS BASIS, THE ENTIRE RISK AS TO THE QUALITY AND PERFORMANCE OF THE NOUVIE™ IS WITH THE BUYER, AND IF THE NOUVIE™ PROVES DEFECTIVE AFTER PURCHASE, THE BUYER AND NOT NOUVIE COMFORTS, THE MANUFACTURER, DISTRIBUTOR, OR RETAILER, ASSUMES THE ENTIRE COST OF ALL NECESSARY SERVICING OR REPAIR.

NOUVIE COMFORTS SHALL NOT BE LIABLE OR BEAR ANY RESPONSIBILITY FOR LOSS OF USE OF THE NOUVIE™, LOSS OF TIME, INCONVENIENCE, COMMERCIAL LOSS, OR OTHER CONSEQUENTIAL OR INCIDENTAL ECONOMIC LOSS OR OTHERWISE SIMILAR DAMAGES ARISING OUT OF ANY BREACH OF THE LIMITED WARRANTY PROVIDED HEREIN.

SOME STATES DO NOT ALLOW LIMITATIONS ON DISCLAIMING IMPLIED WARRANTIES OR ALLOWING THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES SO THE ABOVE LIMITATIONS OR EXCLUSIONS MAY NOT APPLY TO YOU.
